These Terms of Use ("Terms") govern your use of the PixClean mobile application ("App") provided by Anton Caliente ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Use of the App

PixClean is a photo editing application that uses artificial intelligence to help you edit photos. You may use the App for personal and commercial purposes (such as editing product photos) in accordance with these Terms.

You agree not to:

• Use the App to create, distribute, or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Use the App to infringe on the intellectual property rights of others
• Attempt to reverse-engineer, decompile, or disassemble the App
• Attempt to bypass or circumvent any security measures, rate limits, or usage restrictions
• Use automated means (bots, scripts) to access the App's services
• Edit photos of individuals without their consent for deceptive purposes (deepfakes, misinformation)

2. AI-Powered Processing

The App uses third-party AI services (Google Vertex AI) to process your photos. You acknowledge that:

• AI processing results may not always be perfect and may vary in quality
• Photos selected for AI processing are transmitted to external servers for processing
• Photos are processed in real-time and immediately discarded — they are not stored on any server
• We are not responsible for the accuracy, quality, or suitability of AI-generated results

3. Subscriptions and Payments

PixClean offers subscription plans that unlock premium features. Subscriptions are managed and billed through Apple's App Store.

• Free tier: Limited number of edits using the Remove feature
• Pro Weekly: All features, billed weekly after a 3-day free trial
• Pro Annual: All features, billed annually after a 3-day free trial

Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Free trial: If offered, the free trial period begins when you subscribe and ends after the specified duration. If you don't cancel before the trial ends, your subscription will automatically convert to a paid subscription.

Cancellation: You can cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Manage subscriptions: Go to iPhone Settings → [Your Name] → Subscriptions → PixClean.

4. Intellectual Property

The App, including its design, code, features, and content, is owned by Anton Caliente and is protected by copyright and other intellectual property laws. You retain full ownership of any photos you edit using the App. We claim no rights to your photos or edited results.

5. Content Responsibility

You are solely responsible for the photos you edit and any results you create, share, or distribute using the App. You represent that you have the right to use and edit any photo you select, and that the resulting edited images do not violate any applicable laws or third-party rights.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI processing results will meet your expectations. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Anton Caliente shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the App.

8. Indemnification

You agree to indemnify and hold harmless Anton Caliente from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or your violation of these Terms.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date and posting the revised Terms on this page. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction of the developer's residence, without regard to conflict of law principles.
